Terms of Use

This User Agreement (hereinafter referred to as the "Agreement") is a public offer of IP Ingachev Anton Alexandrovich (hereinafter referred to as the "Administration") in accordance with Article 398 of the Civil Code of the Kyrgyz Republic (CC KR) and is addressed to an unlimited number of individuals and legal entities who accept this Agreement (hereinafter referred to as the "User") under the conditions specified below.

By completing the registration process on the website https://miniappsbuilder.com, the User acknowledges acceptance of this offer under Article 399 of the Civil Code of the Kyrgyz Republic, meaning unconditional and absolute acceptance of all terms of this Agreement without any exceptions or limitations.

1. Terms and Definitions

1.1. Platform – a software complex owned by the Administration, designed for launching and supporting bots and processing databases. 1.2. Bot – an automated software algorithm interacting with the Platform and other Internet resources via the User’s account in the Telegram messenger. 1.3. Content – images, videos, links, text, and other information published by the User within the Bot. 1.4. Website – a collection of graphic and informational materials, as well as software and databases, available on the Internet at https://miniappsbuilder.com. 1.5. Tariff – the scope of the Platform’s functionality provided to the User for a fee.

2. Subject

2.1. Under the Agreement, the Administration grants the User the right to use the Platform through a web/mobile interface and other tools under a simple (non-exclusive) license for the duration of the selected Tariff. 2.2. The User utilizes the Platform and its elements within the limits and methods specified in the Agreement and the selected Tariff.

3. Registration

3.1. To access the Platform’s functionality, the User must register (via Google or email) or log in using a Telegram account. 3.2. Registration is performed by completing a registration form on the Website https://miniappsbuilder.com. During registration, the User selects a username and password. 3.3. Unless proven otherwise, any actions performed using the User’s login and password are considered executed by the respective User. 3.4. The User is responsible for:

• Keeping their login and password secure.
• Any consequences arising from the loss and/or disclosure of login and password to third parties.
• The content published by the User.

3.5. The processing of the User’s personal data is carried out in accordance with the legislation of the Kyrgyz Republic and the Privacy Policy, available in a dedicated section of the Website. 3.6. The User is responsible for the accuracy, relevance, completeness, and compliance of the provided information with the laws of the Kyrgyz Republic.

4. User Responsibilities

4.1. The User agrees:

• To independently ensure the security of their login and password.
• To provide accurate information and comply with the terms of the Agreement.
• Not to use the Platform for illegal purposes, including violating third-party rights.
• To ensure that any published Content complies with the Agreement and the laws of the Kyrgyz Republic.

4.2. The User may:

• Request termination of their account and deletion of their data. The Administration will delete the User’s data within three (3) business days from the date of such request.
• Publish information not prohibited by the Agreement.

5. Administration Rights and Obligations

5.1. The Administration agrees to:

• Provide access to the Platform’s functionality in accordance with the selected Tariff.
• Notify Users in advance of any circumstances affecting the Platform’s operation.

5.2. The Administration has the right to:

• Request verification of the information provided by the User during registration.
• Restrict access to the Platform for Users violating the Agreement.
• Modify Tariffs, update, or enhance the Platform without the User’s consent.
• Take measures to detect and prevent fraudulent activities.
• Display advertisements and promotional materials on the Website and Bots.
• Modify this Agreement.

6. Intellectual Property

6.1. The Platform, including all its components, is the intellectual property of the Administration. Any actions violating the Administration’s exclusive rights are prohibited. 6.2. The User may use the Administration’s trademark solely for advertising purposes related to Platform usage. 6.3. The User retains ownership of the Content they publish, and the Administration does not claim rights over it.

7. Tariffs

7.1. The Platform’s functionality is available under a paid (non-exclusive license) model. 7.2. The pricing, duration, and scope of access are determined by the selected Tariff. 7.3. Free Tariffs are provided without a usage time limit. 7.4. The Administration may modify Tariffs unilaterally. 7.5. Payments are processed via https://freedompay.kg. 7.6. Refunds are subject to specific conditions outlined in the Agreement.

8. Limitations of Liability

8.1. The Administration is not responsible for direct or indirect losses incurred by the User while using the Platform. 8.2. The Administration is not responsible for actions or inactions of third-party services integrated with the Platform. 8.3. The Administration’s liability under this Agreement is limited to the cost of the Tariff paid by the User.

9. Dispute Resolution

9.1. Any disputes arising from this Agreement shall be resolved through a pre-trial claims procedure. 9.2. If an agreement is not reached, the dispute shall be referred to a court at the Administration’s location. 9.3. This Agreement is governed by the laws of the Kyrgyz Republic.

10. Final Provisions

10.1. The place of conclusion and enforcement of this Agreement is the Administration’s legal address. 10.2. The Administration reserves the right to modify this Agreement. The new version takes effect upon publication on the Platform. 10.3. The User’s continued use of the Platform after changes to the Agreement constitutes acceptance of such changes. 10.4.
