This User Agreement (hereinafter referred to as the "Agreement") is a public offer of Mini Apps Builder, Inc. (EIN: 32-0810941, a corporation incorporated in the State of Delaware, USA; registered agent: Legalinc Corporate Services Inc., Newark, DE) (hereinafter referred to as the "Administration") addressed to an unlimited number of individuals and legal entities who accept this Agreement (hereinafter referred to as the "User") under the conditions specified below.

By completing the registration process on the website https://miniappsbuilder.com, the User acknowledges unconditional and absolute acceptance of all terms of this Agreement without any exceptions or limitations.

1. Terms and Definitions

1.1. Platform – a software complex owned by the Administration, designed for launching and supporting bots and processing databases. 1.2. Bot – an automated software algorithm interacting with the Platform and other Internet resources via the User's account in the Telegram messenger. 1.3. Content – images, videos, links, text, and other information published by the User within the Bot. 1.4. Website – a collection of graphic and informational materials, as well as software and databases, available on the Internet at https://miniappsbuilder.com. 1.5. Tariff – the scope of the Platform's functionality provided to the User for a fee.

2. Subject

2.1. Under the Agreement, the Administration grants the User the right to use the Platform through a web/mobile interface and other tools under a simple (non-exclusive) license for the duration of the selected Tariff. 2.2. The User utilizes the Platform and its elements within the limits and methods specified in the Agreement and the selected Tariff.

3. Registration

3.1. To access the Platform's functionality, the User must register (via Google or email) or log in using a Telegram account. 3.2. Registration is performed by completing a registration form on the Website https://miniappsbuilder.com. During registration, the User selects a username and password. 3.3. Unless proven otherwise, any actions performed using the User's login and password are considered executed by the respective User. 3.4. The User is responsible for:

  • Keeping their login and password secure.
  • Any consequences arising from the loss and/or disclosure of login and password to third parties.
  • The content published by the User.

3.5. The processing of the User's personal data is carried out in accordance with applicable data protection law and the Privacy Policy, available at https://miniappsbuilder.com/privacy-policy. 3.6. The User is responsible for the accuracy, relevance, completeness, and compliance of the provided information with applicable law. 3.7. The Platform is intended for use by individuals aged 18 and older. By registering, the User confirms that they meet this age requirement.

4. User Responsibilities

4.1. The User agrees:

  • To independently ensure the security of their login and password.
  • To provide accurate information and comply with the terms of the Agreement.
  • Not to use the Platform for illegal purposes, including violating third-party rights.
  • To ensure that any published Content complies with this Agreement and applicable law.

4.2. The User may:

  • Request termination of their account and deletion of their data. The Administration will delete the User's data within thirty (30) days from the date of such request.
  • Publish information not prohibited by this Agreement.

5. Prohibited Uses

5.1. The User must not use the Platform to:

  • Sell, distribute, or advertise illegal goods or substances, including narcotics, weapons, counterfeit goods, or any items prohibited under applicable law;
  • Publish or distribute content that violates third-party intellectual property rights;
  • Publish or distribute content that is defamatory, obscene, or constitutes hate speech;
  • Distribute malware, phishing links, or engage in fraudulent activities;
  • Violate the laws of any jurisdiction in which the User operates or offers services;
  • Collect personal data of third parties without their consent.

5.2. The Administration reserves the right to suspend or terminate access to the Platform for Users who violate this Section without prior notice and without refund of any paid Tariff fees.

6. Administration Rights and Obligations

6.1. The Administration agrees to:

  • Provide access to the Platform's functionality in accordance with the selected Tariff.
  • Notify Users in advance of any material circumstances affecting the Platform's operation.

6.2. The Administration has the right to:

  • Request verification of the information provided by the User during registration.
  • Restrict or terminate access to the Platform for Users violating the Agreement.
  • Modify Tariffs, update, or enhance the Platform.
  • Take measures to detect and prevent fraudulent activities.
  • Display advertisements and promotional materials on the Website and Bots.
  • Modify this Agreement, with changes taking effect upon publication on the Platform.

7. Intellectual Property

7.1. The Platform, including all its components, is the intellectual property of the Administration. Any actions violating the Administration's exclusive rights are prohibited. 7.2. The User may use the Administration's trademark solely for advertising purposes related to Platform usage. 7.3. The User retains ownership of the Content they publish, and the Administration does not claim rights over it.

8. Tariffs and Payments

8.1. The Platform's functionality is available under a paid (non-exclusive license) model. 8.2. The pricing, duration, and scope of access are determined by the selected Tariff, as published at https://miniappsbuilder.com/pricing. 8.3. New Users receive a 14-day free trial period upon registration. No payment method is required to start the trial. After the trial period expires, access to the Platform requires the selection and payment of a Tariff. 8.4. The Administration may modify Tariffs unilaterally, with prior notice published on the Platform. 8.5. Payments are processed through the following payment providers, depending on the User's region: Stripe (international), Click (Uzbekistan), Payme (Uzbekistan), Kaspi QR (Kazakhstan), and other providers as may be added from time to time. 8.6. Refunds are provided at the Administration's discretion and are subject to applicable consumer protection law. To request a refund, the User must contact support@miniappsbuilder.com within 14 days of the charge.

9. Limitations of Liability

9.1. The Administration is not responsible for direct or indirect losses incurred by the User while using the Platform. 9.2. The Administration is not responsible for actions or inactions of third-party services integrated with the Platform, including payment processors and messaging platforms. 9.3. The Administration's liability under this Agreement shall not exceed the total amount of Tariff fees paid by the User during the three (3) months preceding the event giving rise to the claim.

10. Dispute Resolution

10.1. Any disputes arising from this Agreement shall first be attempted to be resolved through a pre-trial claims procedure. The User must submit a written claim to support@miniappsbuilder.com and allow the Administration 30 days to respond. 10.2. If an agreement is not reached through the claims procedure, the dispute shall be submitted to binding arbitration or a court of competent jurisdiction in the State of Delaware, USA. 10.3. This Agreement is governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

11. Final Provisions

11.1. The place of conclusion and enforcement of this Agreement is the State of Delaware, USA. 11.2. The Administration reserves the right to modify this Agreement. The new version takes effect upon publication on the Platform. The Administration will notify Users of material changes via email or a notice within the Platform at least 7 days before the changes take effect. 11.3. The User's continued use of the Platform after changes to the Agreement constitutes acceptance of such changes. 11.4. The current version of the Agreement is always available at https://miniappsbuilder.com/terms-of-use.
